Please read these terms carefully before using The DowUrk FramewUrk platform.
By accessing or using The DowUrk FramewUrk platform ("Platform"), operated by DowUrk Inc., a Louisiana nonprofit corporation ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.
These Terms apply to all visitors, users, and others who access or use the Platform, including our website at dowurktoday.org, mobile applications, and all related services (collectively, the "Services").
Age Requirements
You must be at least 18 years old to create an account and use most features of the Platform. Users between 13-17 years old may access certain features with verified parental or guardian consent through our Youth Pipeline program.
Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate, current, and complete information during registration.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
You agree NOT to use the Platform to:
- Violate any applicable local, state, national, or international law or regulation.
- Harass, abuse, or harm another person, or engage in discriminatory behavior.
- Impersonate any person or entity, or misrepresent your affiliation.
- Upload or transmit viruses, malware, or other malicious code.
- Interfere with or disrupt the Platform or servers or networks connected to it.
- Scrape, crawl, or use automated means to access the Platform without permission.
- Use the Platform to promote pyramid schemes, multi-level marketing, or fraudulent activities.
- Post false, misleading, or deceptive content about your business or services.
- Infringe upon the intellectual property rights of others.
We reserve the right to investigate and take appropriate legal action against anyone who violates this provision, including removing offending content and terminating accounts.
Free Tier (Seed)
Basic access to the Platform is provided free of charge. Free tier users have access to limited features as described on our membership page.
Paid Subscriptions (Growth, Scale)
- Paid subscriptions are billed monthly or annually, as selected at checkout.
- All fees are quoted in U.S. dollars and are non-refundable except as required by law.
- Subscriptions automatically renew unless cancelled before the renewal date.
- You may cancel your subscription at any time through your account settings.
- We reserve the right to change pricing with 30 days' advance notice.
Donations & BOGO Programs
Donations made through the Platform are processed by Stripe and are generally tax-deductible to the extent allowed by law. BOGO (Buy One, Give One) contributions help deploy resources to underserved entrepreneurs.
Refund Policy
Subscription fees are non-refundable. However, if you believe you have been charged in error, please contact us within 30 days at support@dowurktoday.org.
Our Content
The Platform and its original content, features, and functionality are owned by DowUrk Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. The DowUrk® name and logo are registered trademarks.
Your Content
You retain ownership of content you submit to the Platform ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and display such content in connection with operating and promoting the Platform.
PROOF Badges & Credentials
Badges earned through the PROOF system remain the intellectual property of DowUrk Inc. Users are granted a personal, non-transferable license to display and share their earned credentials. Badges comply with the Open Badge 2.0 standard and can be verified independently.
The Seven F's FramewUrk
Our Seven F's platforms (Faith, Fitness, Foundation, Food, Finances, Fashion, Film) each have specific guidelines and expectations. By participating in any platform, you agree to:
- Faith wUrks: Respect diverse spiritual and secular perspectives.
- wUrkFit: Consult healthcare providers before starting fitness programs.
- School 4 Thought: Complete coursework honestly without plagiarism.
- Farm2Table: Accurately represent heritage recipes and their origins.
- Financial Literacy: Understand that content is educational, not financial advice.
- LegacyStudio: Respect copyright laws when sharing creative work.
Community Guidelines
All users must follow our Community Guidelines, which promote respect, authenticity, and constructive engagement. Violations may result in content removal or account suspension.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE"
We make no warranties, expressed or implied, regarding the Platform's operation, accuracy, reliability, or availability. We do not warrant that the Platform will be uninterrupted, secure, or error-free.
Not Professional Advice
- Financial content is for educational purposes only and does not constitute financial, investment, or tax advice.
- Wellness content does not replace professional medical or mental health treatment.
- Business formation tools assist with paperwork but do not constitute legal advice.
- Always consult qualified professionals for specific guidance.
Third-Party Services
The Platform may integrate with third-party services (Stripe, SendGrid, etc.). We are not responsible for the practices or content of these services. Your use of third-party services is subject to their respective terms and policies.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOWURK INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or business opportunities
- Personal injury or property damage
- Unauthorized access to or alteration of your data
- Conduct of any third party on the Platform
- Any other matter relating to the Platform
Our total liability for any claims arising from your use of the Platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless DowUrk Inc. and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Platform
- Your User Content
- Your violation of these Terms
- Your violation of any rights of another party
- Your violation of any applicable law or regulation
We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination:
- Your right to use the Platform will immediately cease.
- We may delete your account and User Content.
- Provisions that by their nature should survive termination will survive (including ownership, disclaimers, indemnification, and limitations of liability).
You may terminate your account at any time by contacting us or using the account deletion feature in your settings.
These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, United States, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Hammond, Louisiana, in accordance with the rules of the American Arbitration Association.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. For significant changes, we may also send email notifications to registered users.
Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Platform.
